Terms of Service

1. Parties

This Terms of Service ("Agreement") enters into force between the service provider located at Berk İş Hanı No:1/801 Osmangazi/Bursa on one hand, and the real or legal person ("User") using Pratik Menü services on the other hand, upon the User's approval in electronic environment.

2. Definitions

• Service: QR menu creation, management and publishing services provided by Pratik Menü
• Platform: Website and management panel accessed through the domain name pratikmenu.tr
• Account: User account created by the User to access the Platform
• Content: All text, images and other materials uploaded to the Platform by the User

3. Scope of Service

The Company provides the following services to the User:

• Digital QR menu creation and editing
• Menu categories and product management
• QR code creation and customization
• Multi-language support
• Management panel access
• Technical support services

4. Account Creation and Security

4.1. The User is obliged to provide accurate and up-to-date information when creating an account.

4.2. The User is responsible for the confidentiality of account information and all transactions performed through the account.

4.3. In case of unauthorized use of account information or security breach, the User must immediately notify the Company.

5. User Obligations

User:

• Will use the Platform only for legal purposes
• Will not upload content that violates the rights of third parties
• Will not engage in activities that endanger the security of the Platform
• Will not spread spam, malicious software or unwanted content
• Will not attempt to gain unauthorized access to others' accounts
• Will comply with all applicable laws and regulations

6. Intellectual Property Rights

6.1. The design, software, logos and all content of the Platform are the property of the Company and are protected by copyright laws.

6.2. The ownership of content uploaded by the User belongs to the User. However, the User grants the Company an unlimited, royalty-free license for the publication of this content on the Platform.

7. Pricing and Payment

7.1. Service fees are determined according to the current price list.

7.2. Payments must be made on the specified due date.

7.3. Legal interest may be applied for delayed payments.

7.4. In case of non-payment, the Company has the right to suspend or terminate the service.

8. Trial Period

8.1. A 15-day free trial period is offered to new users.

8.2. At the end of the trial period, if the user does not switch to a paid subscription, account access will be restricted.

9. Service Level

9.1. The Company will make maximum effort to ensure the Platform operates with 99.9% availability.

9.2. Planned maintenance work will be announced in advance.

9.3. The Company cannot be held responsible for interruptions that may occur due to force majeure (natural disasters, war, internet infrastructure problems, etc.).

10. Limitation of Liability

10.1. The Company is not responsible for indirect, special, incidental or punitive damages arising from the User's use of the Platform.

10.2. The Company's total liability is limited to the service fee paid by the User in the last 12 months.

11. Privacy

The processing of User data is subject to the principles specified in the Privacy Policy.

12. Termination of Agreement

12.1. The User can close their account at any time.

12.2. The Company may suspend or terminate the account in case of breach of agreement.

12.3. When the agreement ends, User data will be deleted after a reasonable period.

13. Changes

The Company reserves the right to change this Agreement with prior notice. Changes become effective on the date they are published on the Platform.

14. Dispute Resolution

Turkish Republic law applies to disputes arising from this Agreement. Bursa Courts and Enforcement Offices are authorized for the resolution of disputes.
